Terms of Use

The purpose of these Terms of Use is to ensure the implementation of a transparency, privacy, and security policy for both parties involved, allowing for the best use of the portal by its users. In these terms, you and/or your entity will collectively be referred to as the "user." By clicking the accept button, the user declares being aware of all the terms of use of Medcloud specified below. Medcloud, under no circumstances, provides medical, laboratory, or general health services.

Welcome to Medcloud! Our services are provided exclusively via the internet, aiming to serve the user by offering online radiology documents and facilitating interaction between doctors, patients, and access to their exams and diagnoses.

1. The system begins with the use of the platform by a registered imaging center. Upon request from the patient or doctor, the user will receive a document with "Access Instructions," which can be sent by email or provided at the imaging center, containing all the clinic, username, password, and system access instructions. With this information, the user can access their exam or provide the data to their doctor for consultation.

2. The user may change the password after the first access.

3. In consideration of using the Service, the user agrees to: provide truthful, accurate, current, and complete information about themselves when registering in the form for access to the Service; promptly update such registration information to maintain it as true, accurate, current, and complete. If any information provided by the user is false, incorrect, outdated, or incomplete, or if Medcloud has sufficient reasons to suspect that such information is false, incorrect, outdated, or incomplete, it has the right to suspend or immediately cancel the user’s account without notice and refuse any present or future use of the Service, or any part of it.

4. Medcloud is not responsible for medical data, only replicating information provided by clinics and doctors, with no confusion between the responsibility for the exam and services provided by the clinics. Medcloud acts as a technology company in the healthcare sector. Medical exams, reports, and imaging findings are the exclusive responsibility of the hospital, center, clinic, and attending doctors.

5. Authorization for access to patient information is the user's sole responsibility. Medcloud is only responsible for storing and making exams available via the cloud.

6. Medical professionals, including clinics, doctors, centers, and hospitals, are responsible to third parties for any damages caused due to exams or treatments performed within their facilities or under their responsibility.

7. The user must have internet access for sending and receiving information, which will be transmitted securely according to the relevant technical rules.

8. The user is fully aware and agrees that Medcloud has no responsibility for the proper maintenance of the computer network (internet), as interruptions and delays in the exchange of information may occur, in which case no responsibility will be attributed to any of the parties involved.

9. The user should always keep the confidentiality of their medical documents, providing them only to qualified professionals who are authorized to handle, analyze, and interpret them correctly, as well as the system access credentials, which should only be provided to the aforementioned professionals.

10. The software and all related equipment, cloud technologies, and intellectual property rights, trademarks, and patents are exclusively owned by Medcloud. The user may use the software only to the extent necessary to enjoy the services, and may not use it for any other purpose.

11. The patient user agrees and consents that authorized medical professionals may share their exams on the Medcloud platform.

12. Data stored by Medcloud is the responsibility of the clinic, requesting doctor, hospital, or center, with final responsibility for storage lying with the requester. Medcloud cannot be held responsible for the storage of this information in the event of termination of the relationship with any of these entities.

13. Medcloud will not use patient personal data, nor share or provide it to third parties for any purpose or under any pretext.

14. Data stored by Medcloud is the responsibility of the clinic, requesting doctor, hospital, or center, with final responsibility for storage lying with the requester. Medcloud cannot be held responsible for the storage of this information in the event of termination of the relationship with any of these entities.

15. Access to information will be available for the duration of the service contract between the Imaging Center and Medcloud. When the exam is no longer available on the system, the user must request copies directly from the responsible Imaging Center.

16. The user agrees to fully accept the platform provided, not to modify, copy, rent, sell, distribute, reverse-engineer, or create derivative works from the Service, in whole or in part, and to accept system updates as well as updates to the site and policies in general, which may be changed unilaterally by Medcloud without prior notice.

18. This service and use agreement will be governed by and interpreted according to the Brazilian Civil Code and other applicable regulations. Medcloud and the user hereby irrevocably and unconditionally agree to the jurisdiction of the Ponta Grossa, Paraná court to resolve any disputes or controversies arising from this agreement, excluding any other jurisdiction, regardless of its privilege.
